SCOPE OF THE PRESENT TERMS AND CONDITIONS
a) All orders placed with Caffitaly System over the internet are subject to the present Terms and Conditions of Sale, which comply with current regulations covering contracts concluded away from business premises. When placing an order, the Buyer acknowledges that he or she has red, understood and accepted the present Terms and Conditions of Sale.
b) Caffitaly System reserves the right to change the present Terms and Conditions of Sale and publish new versions of the same on this website at any time. All orders shall be subject to the Terms and Conditions in force when the order is made.
REGISTRATION: USERNAME AND PASSWORD
a) Users must register an account before placing an order. All information provided in mandatory fields must be complete and accurate.
b) Buyers are required to promptly update their profile if their contact or other relevant information changes.
c) When registering their account, Buyers will be required to create a password. Passwords are strictly personal and confidential and must therefore not be communicated to any third parties.
d) Buyers take full responsibility for any use of their password and for all orders placed using the same password, even unbeknown to the Buyer.
e) Buyers who suspect or find out that someone else is using their password are required to immediately inform Caffitaly System.
f) Upon registration, the System will assign a customer code to every new user. Buyers may use the customer code and password to log on to the system and access their Caffitaly System personal area.
g) When registering a Caffitaly System account, Buyers are authorising the processing of their personal data according to the provisions of Italian data protection regulations (law 675/96 and subsequent amendments and additions). (see data protection briefing)
h) Caffitaly System collects and processes user data to the sole purpose of improving and integrating its services. User data may for instance be processed to advertise our products and services, send invoices, monitor our quality and performance levels to improve our business development strategies, or to contact Buyers when we deem it necessary.
ORDERS
a) When placing an order on this website, the Buyer undertakes to purchase the selected products pursuant to the provisions listed in the present Terms and Conditions.
b) Orders may not be cancelled or modified once they have been transmitted by the Buyer. Please check your order carefully before transmission.
c) Products advertised by Caffitaly System on this website are subject to availability while stocks last.
d) Caffitaly System reserves the right to reject an order for any reason, in particular if payment of previous invoices is still outstanding.
e) Data collected by Caffitaly System may be used as proof of the order and of the entire transaction. The data recorded through our payment system shall constitute proof of the financial transaction.
PRICE
a) Orders will be priced according to the prices published on this website at the date of the order. Prices do not include VAT. Prices do not include shipping.
b) Shipments are priced according to the rates applicable at date of the order.
c) Caffitaly System reserves the right to change its prices and shipment rates at any time and to cancel an order in the event of evident failure on part of the system to calculate the correct price for the order or if incorrect data are fed into the system.
DELIVERY
a) All orders will be delivered to the shipment address provided by the Buyer when the order is placed.
b) Estimated delivery dates are not binding for Caffitaly System. The company will nevertheless strive to ensure delivery by the estimated delivery date.
c) Goods are delivered in Italy exclusively.
d) The Buyer shall check the goods for any damage upon delivery.
e) If the goods are damaged or quantities are not correct, the Buyer shall inform the shipping agent, record his or her findings in the bill of delivery and notify Caffitaly System within 3 days of delivery. Caffitaly System shall conduct the necessary checks and, if applicable, replace the missing or damaged goods.
f) The Buyer may chose to have the goods delivered either to a specific address between 9 am and 6 pm or to a conveniently located Bartolini pick-up point.
INVOICING
Invoices will be sent along with the purchased goods.

Force Majeure
Caffitaly System shall undertake all necessary efforts to meet its contractual obligations but may not be held responsible for late or no delivery owing to circumstances reasonably beyond its control. Said circumstances include (but are not limited to) strikes, war, natural catastrophe or any other events making it practically impossible to manufacture, ship or deliver the products.
PLACE OF PERFORMANCE AND COMPETENT JURISDICTION
The present Terms and Conditions are subject to Italian law. All aspects not explicitly covered by the present Terms and Conditions shall be governed by Italian Law Decree 185/99, implementing European directive 97/7/EC on the protection of consumers protection in respect of distance contracts.
Litigations concerning the present Terms and Conditions as well as the purchase itself shall be settled in the Court of Milan, Italy.
Caffitaly System Spa is a single-member joint-stock company.
